What Is The Tea Party Court Case?
On May 8, 2001 the Defendant in this case, Lotus, acting as a member of the Teller-Woodland Green Tea Party, put on a triangular American Revolution hat, participated in a demonstration outside the Woodland Park Colorado polling place,and then threw nine dry green tea bags at the vote counting computer located at the polling place.
This modern day tea party was a protest against the use of computers to count votes, and a protest against the illegal, biased and corrupt decision by District Court Judge Parrish who ignored Lotus's expert witness at a hearing on whether or not computers should be allowed to count the votes in this election. One of the questions on the ballot in this election was whether or not votes in future Woodland Park elections would be counted by hand or by computer.
It is time for another revolution. As the Teller-Woodland Green Tea Party News Release stated: “Lotus hopes to be the first person on planet earth to be arrested for assaulting a vote counting computer with green tea bags.” For his Tea Party Lotus was sentenced to ten days in jail, and $638 in fines and court costs. The case is currently on appeal to the U.S. Supreme.
Why The Tea Party Court Case Is Important:
Central to this case is how votes are counted – the foundation of our Republic -- and whether or not people should be allowed to assert their Constitutionally protected symbolic free speech at a polling place during an election when the target of that speech is a vote counting computer.
This case argues for allowing citizens to use the choice of evils defense for putting government policy on trial in front of a jury. An example of a government policy that could be put on trial is how the votes are counted. Putting government policy on trial in front of a jury is currently more often than not disallowed.
Jurors are currently lied to and deceived by judges, their power greatly reduced. These illegal procedures are a far cry from what the U.S. Constitution describes.
John Jay, the first Chief Justice
of the U.S. Supreme Court, stated: "The jury has a right to
judge both the law as well as the fact in controversy."

As Thomas Jefferson put it to Tom Paine in a 1789 letter, "I consider trial by jury as the only anchor ever yet imagined by man,by which a government can be held to the principles of its constitution." According to the attorney Lysander Spooner in “An Essay On The Trial By Jury” :
“For more than 600 years, since the Magna Carta, there has been no clearer principle in English or American Constitutional Law than that in criminal cases it is not only the right and the duty of juries to judge what are the facts, and what is the law, and what was the moral intent of the accused; but that it is also their right and their primary and paramount duty to judge of the justice of the law, and to hold all laws invalid, that are, in their opinion, unjust or oppressive, and all persons guiltless in violating, or resisting the execution of such laws.”
“Unless be the right and
duty of jurors, it is plain that, instead of juries being a palladium of
liberty -- a barrier against tyranny
and oppression of the government – they are really mere tools in its hands, for carrying into execution any injustice and oppression it may desire to have executed.”
So the above is what was meant by a trial by jury when the U.S. Constitution, the Bill of Rights, and the Colorado Constitutions were created. Since the Constitutions are the highest law in the U.S.A., and since these Constitutions have not been amended, this reduction in the power of juries is clearly illegal and treasonous.

What The Tea Party Court Case Will Hopefully Accomplish:
The Tea Party Court Case is being done on behalf of freedom loving people everywhere. There is a lot at stake in this case that affects individuals and organizations across the U.S.A. This case has the potential of defining what symbolic free speech can be used at election polling places during elections. Most of the laws pertaining to computer vote counting are despotic laws by despotic governments. Restoring the power of juries and expanding the choice of evils, or necessity, defense so that it more often can be used to consider government policy could go a long way toward checking the despotism that is increasingly rampant in this country. These changes could also result in the Tea Party putting vote-counting computers on trial – the issue this case is primarily about.
How About Having A Tea Bag Party Of Your Own?
The second tea party happened on May 8, 2001. Now you can join the fun, the revolution, by spreading the word that this case is being appealed to the U.S. Supreme Court, and by getting involved in the voting integrity movement. Maybe some day you will also don a triangular American Revolution Hat and have a Tea Bag Party of your own. How much is freedom worth? Let's have Tea Bag Parties all over Mother Earth. Governments may be able to eat and manipulate our vote, but a direct action like throwing tea bags at a vote counting computer while donning a triangular revolutionary hat is a loud and clear statement that is very difficult to distort the meaning of. So rather than ignoring the polling places on election day take signs, cameras, tea bags and consider having a modern day Tea Bag Party of your own.
